Relief routes in Georgia

Georgia’s state habeas process is distinct from a motion for new trial and a direct appeal. The Georgia Courts inmate forms include a habeas application. The 2025 HB 176 legislation also created a statutory route for seeking permission for certain out-of-time filings.

Separate the original conviction record from the habeas record. Identify the current place of confinement, the conviction court, the appeal history, and every prior collateral filing. A familiar city or the location of a family member does not by itself establish the proper habeas venue.

Timing and earlier filings

The official habeas instructions refer to different limitation periods for felony and misdemeanor cases. HB 176 has separate short windows; its special provision for specified Cook-related dismissals ended June 30, 2026. A missed deadline requires a case-specific review, not a generic form.
