For Georgia help, ask whether the service addresses a still-pending new-trial motion, a habeas proceeding or executive clemency. A lawyer handling a new-trial hearing has a different role from a company organizing a pro se habeas application. Georgia Courts publishes an inmate form, and the State Board of Pardons and Paroles publishes clemency information. HB 176 additionally provides an assistance-of-counsel right for indigent defendants seeking relief under its new out-of-time provision; a paid preparer is not the appointed attorney contemplated by that provision.

Georgia’s official habeas application separates the original conviction, appeals, earlier collateral proceedings and individual grounds. Its instructions identify different limitation periods for felony and misdemeanor judgments. Finality, a later-accruing statutory basis and the relevant exception must be examined together; a four-year or one-year number cannot be applied just by counting from the date someone first contacted a provider. The form is a starting resource, not a ruling on eligibility or timeliness.
