Georgia new-trial motions and amendments
A Georgia motion for new trial is part of a different track from a state habeas application. Start with the verdict, judgment, motion filing date, hearing record and any disposition. A matter still pending on a timely new-trial motion is not the same procedural situation as a final case with a missed filing. The distinction affects what can be amended, what record can be developed and how later review proceeds.
What the procedure asks you to distinguish
HB 176 revised O.C.G.A. §5-5-40(b): a motion may be amended before the ruling, but a substantial amendment in a criminal case gives the State ten days to respond and present evidence, with a longer period available in the court’s discretion. A directory should not imply that adding a new ground automatically produces an immediate hearing or bypasses notice and response. Keep the original motion and every amendment in chronological order.
Limits and related routes
The law also added a request-for-leave route for specified out-of-time motions or notices. Its generally 100-day request window is measured from expiration of the missed period, and a grant ordinarily gives 30 days to file, subject to the statutory extension provision. It is not indefinite permission to revive every older motion. The separate transitional window for specified previously dismissed out-of-time matters ended June 30, 2026.
