Georgia Courts’ habeas application identifies the warden and institution as well as the conviction court. The instructions cite O.C.G.A. §9-14-42 and describe one-year misdemeanor and four-year noncapital felony limitation periods, subject to the governing statute. Current detention and respondent information should be checked instead of selecting venue from a family member’s city. Service also matters: the form describes serving the custodian plus the Attorney General for Department of Corrections custody, or the specified district attorney in other custody situations. It is not the same filing as a criminal notice of appeal.
