El Paso: county criminal records versus federal records

El Paso County publishes an official records-search page with a Criminal Cases route covering County Clerk and District Clerk information. The District Clerk separately lists criminal-division and record-request resources. Use the court name on the judgment to identify the appropriate record keeper, rather than treating every criminal search result as the same kind of case. A state district-court cause number is different from a federal criminal case number.

The county portal warns that displayed information may not be accurate, reliable or complete. A useful search result should therefore lead to the actual filed judgment and orders when preparing a post-conviction packet. Ask the District Clerk about records from a named district-court case; a County Clerk criminal record may concern a different level of court. Record a missing online document as unavailable in the search, not proof that it was never filed.

El Paso’s border location makes a federal-versus-state distinction particularly important when a family remembers only where a hearing occurred. Immigration papers, a state conviction and a federal prosecution can involve different files and deadlines. Keep those document sets apart for a provider to assess. Do not assume a county clerk can certify a federal judgment, or that a provider advertising statewide document preparation can appear as an attorney in either court system.
