Understand which custody and court are involved

Habeas review addresses the legality of custody through a defined procedure. State and federal routes have different requirements. Start with whether the judgment came from a state court or federal court and whether available state procedures have been used.

Texas procedure and this issue

Texas Chapter 11 contains multiple habeas procedures. Article 11.07 concerns final non-death felony judgments; 11.072 concerns community supervision; 11.071 addresses death-penalty cases. Chapter 11 also distinguishes pretrial and misdemeanor matters. The procedure cannot be selected solely because someone is incarcerated in Texas. An 11.07 application is filed with the convicting clerk, and the Court of Criminal Appeals resolves the writ after the statutory process. A prison transfer does not replace that convicting-court record with a new criminal case.

Check the record and procedural history

For a final non-death felony conviction, the Article 11.07 process begins with the clerk of the convicting court and ultimately reaches the Texas Court of Criminal Appeals. A community-supervision case requires separate attention to Article 11.072. Keep the original judgment, revocation history and earlier writ orders together: they determine the procedural category before anyone evaluates the requested relief. A family member’s current city does not move the conviction to a different county.
