Counsel-error MARs have specific record consequences
An NC MAR alleging ineffective trial or appellate counsel needs the actual act or omission, when it occurred and supporting facts. A lost appellate instruction, disputed plea advice and failure to investigate a witness are distinct inquiries; merely calling all three bad lawyering obscures the record. G.S. 15A-1415 expressly addresses counsel-error allegations, so the lawyer file and communications can matter as much as the judgment.
What the procedure asks you to distinguish
Subsection (e) provides an automatic attorney-client privilege waiver to the statutory extent needed for prior counsel to defend against the allegations. That is not a statement that all private communications become publicly available for every purpose. Subsection (f) addresses complete case files and State files where the defendant is represented by post-conviction counsel in superior court, with provisions for disputed material. A non-attorney preparer should not claim the same statutory role as that counsel.
Limits and related routes
Timing and procedural barriers remain separate questions. The 2025 noncapital changes apply to verdicts entered on or after December 1, 2025; the governing version and listed exceptions need review for the actual case. G.S. 15A-1419 requires attention to previous motions and opportunities. Preserve earlier counsel allegations and orders so a new MAR explains what is genuinely different.
