North Carolina procedure and this issue

For North Carolina help, distinguish a lawyer offering MAR representation from North Carolina Prisoner Legal Services’ eligibility-based assistance and the state innocence-review agency’s investigative role. The Commission is not the claimant’s private lawyer or a general appeals office. MAR work requires identifying the applicable G.S. 15A-1415 version and prior proceedings under 15A-1419. A non-attorney preparer’s agreement should describe the document task rather than imply licensed representation. Remote support for a family in Charlotte or Raleigh does not establish an office or shift the conviction’s county.

Check the record and procedural history

North Carolina’s ordinary collateral terminology is Motion for Appropriate Relief, or MAR. Session Law 2025-70 §15 changed noncapital timing and applies to verdicts entered on or after December 1, 2025. The current statute’s seven-year language therefore must not be applied indiscriminately to older verdicts. G.S. 15A-1419 adds separate procedural barriers involving previous proceedings and missed opportunities. An exception to a time limit does not erase every other barrier to review.
