The North Carolina Commission’s distinct role

North Carolina’s Post-Conviction Review Commission investigates statutorily qualifying claims of factual innocence under Article 92. It is a state review body, not the claimant’s law firm or a general service for correcting every trial error. Its official intake explains offense eligibility, claimant participation and evidence requirements. A person should distinguish total factual innocence from a sentencing complaint or an allegation that counsel performed poorly, even if those issues also warrant examination elsewhere.

What the procedure asks you to distinguish

The application should identify the conviction, evidence that was not previously presented or considered as required by the process, and how it supports the innocence claim. Preserve original material and earlier court findings so a reviewer can see what actually changed. A family member can help locate records or ask about an access barrier, but should follow the Commission’s directions about who applies and signs. Selective intake must not be advertised as guaranteed investigation or representation.

Limits and related routes

A Commission inquiry is separate from an MAR under G.S. 15A-1415 and from federal habeas. The MAR’s newly discovered evidence provision includes diligence and reasonable-time considerations; the 2025 noncapital changes have verdict-date application limits. An agency submission should not be represented as automatically stopping another filing period. The directory may connect visitors to the official process and eligibility-based nonprofits while labeling PCRC’s support as non-attorney document preparation, without promising that any referral will vacate the conviction.
