Habeas review addresses the legality of custody through a defined procedure. State and federal routes have different requirements. Start with whether the judgment came from a state court or federal court and whether available state procedures have been used.

North Carolina procedure and this issue

North Carolina visitors searching for state habeas should first distinguish an MAR concerning a conviction or sentence from a federal §2254 petition. MAR timing and grounds are found in G.S. 15A-1415, while 15A-1419 identifies barriers from previous proceedings and missed opportunities. A federal petition has separate custody, exhaustion and limitations requirements. The Fourth Circuit is the relevant regional federal appellate court for North Carolina district courts; it is not the state MAR court. A local prison or family address cannot alone determine the correct federal district or state procedural vehicle.

North Carolina’s ordinary collateral terminology is Motion for Appropriate Relief, or MAR. Session Law 2025-70 §15 changed noncapital timing and applies to verdicts entered on or after December 1, 2025. The current statute’s seven-year language therefore must not be applied indiscriminately to older verdicts. G.S. 15A-1419 adds separate procedural barriers involving previous proceedings and missed opportunities. An exception to a time limit does not erase every other barrier to review.
