Separate innocence evidence from procedural error
A wrongful-conviction inquiry can concern factual innocence, unreliable evidence, or an unfair process. Explain which problem is alleged and what supports it. An innocence organization may review a narrower set of cases than a firm offering general post-conviction representation.
Texas procedure and this issue
In Texas, the evidence problem may point toward more than one mechanism: a habeas claim, an Article 11.073 scientific-evidence inquiry, or a Chapter 64 testing request. These mechanisms do different work. An order permitting testing is not itself an order setting aside the conviction. Innocence Project of Texas and state-supported innocence resources are separate referral options with selective intake. Preserve the original evidence inventory and distinguish an allegation of factual innocence from an allegation that a specific trial procedure was unfair.
Check the record and procedural history
For a final non-death felony conviction, the Article 11.07 process begins with the clerk of the convicting court and ultimately reaches the Texas Court of Criminal Appeals. A community-supervision case requires separate attention to Article 11.072. Keep the original judgment, revocation history and earlier writ orders together: they determine the procedural category before anyone evaluates the requested relief. A family member’s current city does not move the conviction to a different county.
Is the claim that the person did not commit the offense, or that the proceedings were defective? Is there reliable new evidence? Does the organization’s eligibility match the case?
