Investigate allegedly withheld favorable evidence
If information favorable to the defense was withheld, identify the particular material rather than assuming misconduct from a sparse file. Preserve when and how it was obtained, who possessed it, and whether the defense already had equivalent information. A legal review must connect the material to the actual proceedings.

A North Carolina disclosure inquiry should identify the withheld material, who possessed it and its impact on the defense. A constitutional MAR ground is different from treating every missing document as new innocence evidence. G.S. 15A-1415(f) contains specific file-access provisions when the defendant has post-conviction counsel in superior court, including a mechanism for the State to submit disputed material for court inspection. Do not market that provision as unrestricted file access for a non-attorney company. The disclosure chronology also matters to timing and the 15A-1419 review of previous opportunities.

North Carolina’s ordinary collateral terminology is Motion for Appropriate Relief, or MAR. Session Law 2025-70 §15 changed noncapital timing and applies to verdicts entered on or after December 1, 2025. The current statute’s seven-year language therefore must not be applied indiscriminately to older verdicts. G.S. 15A-1419 adds separate procedural barriers involving previous proceedings and missed opportunities. An exception to a time limit does not erase every other barrier to review.
