Relief routes in Florida
Florida Rule 3.850 addresses qualifying collateral challenges to judgments or sentences, including involuntary-plea claims. Rule 3.800 addresses sentence correction, reduction, and modification, while Rule 3.853 provides a procedure for post-conviction DNA testing. These routes are not interchangeable.
Start with the judgment, sentence, appeal disposition, and prior post-conviction motions. Rule 3.850 requires factual grounds, procedural history, and a sworn motion. A request to test DNA and a request to overturn a conviction are different steps.
Timing and earlier filings
Rule 3.850 generally has a two-year limitation measured from finality, with specified exceptions and separate provisions. Rule 3.800 contains distinct subdivisions with different requirements. Confirm the applicable subdivision, finality date, and exception before calculating a filing date.
